Does PASRR apply to hospice?

The Code of Federal Regulations (CFR) at §483.130(d) provides examples of categories for which the State mental health or intellectual disability authority may make an advance group determination that nursing facility (NF) services are needed, that include: (2) Terminal illness, as defined for hospice purposes in §418.3 of this chapter.

Does PASRR apply to swing beds?

A hospital that has a Medicare provider agreement may provide post-hospital extended care services as specified in 42 CFR 409.20. Rural hospitals with fewer than 100 beds are allowed to use their inpatient facilities to furnish skilled nursing facility services to Medicare beneficiaries and Medicaid recipients.

FAQ

Can states refer to the DSM-5 in their operations guidelines related to PASRR, or do they need to incorporate the CFR reference to the DSM III?

Part 42, Subpart C of the Code of Federal Regulations (CFR) contains the guiding regulations for PASRR compliance. Currently, 42 CFR 483.106(b) includes a reference to the DSM-III-R in the definition of serious mental illness; the DSM-III-R was the most current edition of the DSM available when the PASRR regulations were promulgated in 1992.

Resources to develop the type of care and service needed to address issues of long-standing mental disorders, substance use, addictions, and other behavioral health needs are in short supply. This session offers a variety of ideas for anticipating and developing common sense approaches to these contemporary challenges to PASRR compliance. Improving staff education and training in behavioral health and developing strategies to address common symptoms and reactions in mental health are a focus of this conversation.
